DMCA / Intellectual Property

ThumbRival respects intellectual property rights. We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”) and similar applicable law. We may also address other IP concerns where appropriate.
1. User content
Users upload their own thumbnail images. If you believe content on the Service infringes your copyright or other rights, follow the notice procedure below. ThumbRival does not publish user thumbnails to YouTube; if your issue concerns content on YouTube itself, you may also use YouTube’s reporting tools.
2. DMCA takedown notice
If you are a copyright owner (or authorized to act on their behalf), send a written notice to the contact below with:
- Your physical or electronic signature (or that of the person authorized to act).
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it on the Service (for example, URL, account email, approximate time, and description).
- Your contact information (address, phone, email).
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

For postal correspondence, use the business address associated with ThumbRival if we provide one in response to your email, or request a mailing address in your initial notice.
4. Counter-notification
If you believe material was removed in error, you may send a counter notice that meets the requirements of the DMCA (including your consent to jurisdiction and acceptance of service of process in the U.S. federal district court for your address, or in our jurisdiction if outside the U.S., as applicable). We may restore material in accordance with law after receiving a valid counter-notice unless the complaining party initiates further legal action.
5. Repeat infringers
We may terminate or suspend accounts of users who are repeat infringers in appropriate circumstances.
6. Non-copyright IP
For trademark or other non-copyright disputes, email support@thumbrival.com with a clear description of the issue and evidence of your rights. We will review and may take action consistent with applicable law and our Terms.
